Former operational facilities provide a fantastic opportunity to create a bespoke design and unique property for both commercial and residential uses. By their very nature these structures will require creative and innovative designs. Some examples of previously developed similar structures elsewhere in the country are below.
One of the most relevant parts of legislation enabling the conversion of these former operational facilities is the NPPF (National Planning Policy Framework 2012).
Section 6 paragraph 55 of the NPPF states:
To promote sustainable development in rural areas, housing should be located where it will enhance or maintain the vitality of rural communities. For example, where there are groups of smaller settlements, development in one village may support services in a village nearby. Local planning authorities should avoid new isolated homes in the countryside unless there are special circumstances such as:
No, whilst the sites being sold are being promoted together as a portfolio of opportunities each property is available individually.
No, the properties do not have planning consent for conversion or for any alternative uses at the present time. The Vendor has not applied for any change of use and the sites are therefore offered with the benefit of hope value with purchasers able to explore such opportunities as they choose with the relevant Local Planning Authorities.
Yes, there are national planning policies supporting the innovative re-use of similar structures and with an increasingly growing number of examples where applicants have successfully secured planning consent for the conversion of similar structures into a variety of uses including residential dwellings, holiday accommodation and office space.
Paragraph 55 of the National Planning Policy Framework sets out circumstances where developments may be permitted outside of defined urban settlement boundaries. These include heritage circumstances where the proposal would effectively save a listed building from otherwise dereliction. There is also the re-use and enhancement circumstance which gives greater flexibility towards conversions "where the development would re-use redundant or disused buildings and lead to an enhancement to the immediate setting" and there is no need to demonstrate that a business use wouldn’t be viable.
Applicants are encouraged to make their own enquiries of the relevant Local Planning Authority.
The Vendor's preference is to sell the sites unconditionally and with purchasers taking advantage of such planning consents that they achieve following completion of their purchase. If you are unwilling to make an unconditional offer then you need to set out the basis of your offer and the conditions which it is subject to over what timescale very clearly.
The Vendor's preference is to sell the sites unconditionally and without any claw back recovering a percentage of any uplift in value that occurs if you obtain planning consent for an alternative use. If however you make a conditional offer subject to obtaining planning consent that is accepted (this is not the Vendor's preference) then the terms of sale may include, with your agreement, such a claw back.
Each property is being sold by private treaty at this stage with it being likely, depending upon the interest generated, that we will be asked to request sealed “best and final offers” by a set deadline date. Further information will be available from the selling agent, Dalcour Maclaren, in due course
The individual sales particulars sets out what, if any, reservations there will be following completion of the sale. In the substantial majority of cases there are no reservations and no ongoing operational connections such that the properties are free from restraint so far as the Vendor is concerned.
